Terms of Use
The rules for using Fuel. The German version is legally binding.
1. Scope and provider
These terms apply to the use of the Fuel app for iPhone and Android and the website fuel.donner.io. The provider is Dennis Donner, Eduard-v-Winterstein-Straße 11, 14480 Potsdam, Germany (app-support@donner.io). This English version is a translation; the German version is legally binding.
2. The app
Fuel is a logbook for your cars: you record fill-ups and other expenses, see consumption and cost statistics, the total cost of ownership of a car and monthly reports, set reminders, find nearby stations and export your data. Fuel works without a user account.
3. Your data and backups
Your logbook is stored only on your device; I keep no copy. You are responsible for your entries and for backing them up, for example with your device backup or the export function. If you delete the app or lose your device without a backup, I cannot restore your data.
4. Calculations and station data
Consumption, costs, statistics, forecasts and reminders are calculated from your entries. They depend on complete and correct input and are estimates, not a basis for tax, accounting or legal purposes. Station names, locations, opening hours and the amounts stations charge come from third-party sources (Tankerkönig, ANWB, NSW FuelCheck, OpenStreetMap). I do not guarantee that they are complete, correct or current; the amount shown at the pump applies.
5. Safety on the road
Do not use the app while driving. Enter fill-ups and search for stations only when you are parked safely, or let a passenger do it. Use Fuel on CarPlay only when it is safe and permitted by traffic law. Traffic rules and road signs always take precedence over anything shown in the app.
6. Purchases
Some features are offered as in-app purchases, including auto-renewing subscriptions. Purchases are made through the Apple App Store or Google Play and are subject to their terms. Payment, billing, renewal, cancellation and refunds — including any statutory right of withdrawal — are handled by Apple or Google. The current offer and its terms are shown in the app and the store before you buy.
- Cancel: in your Apple ID settings or in Google Play under “Subscriptions”, at the latest 24 hours before the end of the current period. Deleting the app does not cancel a subscription.
- Refunds: via Apple (reportaproblem.apple.com) or Google Play.
- Restore: use “Restore purchases” in the app with the same Apple ID or Google account.
7. Availability and changes
I develop Fuel continuously and may change, add or remove features, as long as this is reasonable for you and paid features you have bought remain available for the period you paid for. Services of third parties (for example station data or maps) may be unavailable at times. I aim for high availability but cannot guarantee uninterrupted operation.
8. Rights to the app
The app, its design and its content are protected by copyright. You receive a simple, non-transferable right to use the app for personal purposes within the store's terms. Your statutory rights, in particular under §§ 69d and 69e of the German Copyright Act (UrhG), remain unaffected.
9. Liability
I am liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where I have given a guarantee. For slight negligence I am liable only for breach of an essential contractual obligation, that is an obligation whose fulfilment makes proper performance possible in the first place and on whose fulfilment you may regularly rely; in that case liability is limited to the typical, foreseeable damage. Otherwise liability is excluded. These rules also apply to my representatives and agents. For features provided without payment, the statutory liability privileges apply.
10. Ending use
You can stop using Fuel at any time by deleting the app. Subscriptions must be cancelled separately (see “Purchases”).
11. Apple and Google
These terms are an agreement between you and me, not with Apple or Google. Apple and Google are not responsible for the app, its content, maintenance or support. If you downloaded the app from the Apple App Store, Apple's Licensed Application End User License Agreement also applies; Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If the app does not conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase amount; Apple has no further warranty obligation. I, not Apple, am responsible for handling claims relating to the app, including product liability, legal compliance and intellectual property claims. Google Play's terms apply to downloads from Google Play.
12. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country in which you habitually reside. I am neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
13. Changes to these terms
I may update these terms if the app, the law or the store rules change. The current version is always available on this page; the date at the top shows when it was last changed. Changes that affect you significantly will be pointed out in the app or on this page in good time.
